According to Art. 15 of the Law of Ukraine “On Protection of Rights to Plant Varieties” Variety authors, applicants, and patent owners of the proprietary rights to varieties in relations governed by this Law may be represented by their representatives, in particular by those specialising in intellectual property, registered following relevant provisions approved by the Cabinet of Ministers of Ukraine. In this case, the relationships with the representatives shall be considered as relationships with the authors, applicants, patent owners and owners of intellectual property rights for the dissemination of the variety.

To register plant varieties in Ukraine through a representative, it is necessary to authorize him/her to sign and submit documents for registration of plant varieties, to provide the payments of state fees, to transfer of seed samples.

The representative’s powers are granted and confirmed by a Power of Attorney (for residents of Ukraine – Notarized Power of Attorney; for foreign companies – Power of Attorney with Apostille) or an Agency Agreement.

Samples of the specified documents will be included in the package of documents for submitting an application for registration of plant varieties.
